EL man gets 32 years for pornography, videos
LISBON — Citing Joseph Frye’s substantial record of videotaping nude females, including a child, and possessing numerous images of child porn, Judge Scott Washam sentenced him to 32 years in prison.
That’s nine years more than what the prosecution and defense had recommended in a joint agreement during the sentencing hearing Thursday in Columbiana County Common Pleas Court.
“How can you just apologize?” Washam interrupted Frye as he was making a statement.
Washam said the conduct was much more serious than what’s on paper and he wasn’t inclined to follow the 23-year sentence recommendation, even though that would give Frye the right to appeal.
He sentenced him to consecutive sentences of seven years each on three counts of illegal use of a minor or impaired person in nudity-oriented or performance, a second-degree felony, and consecutive sentences of one year each on 11 counts of pandering obscenity involving a minor or impaired person, a fourth-degree felony. The terms for the two charges were ordered served consecutively, bringing the grand total of prison time to 32 years.
Frye, 35, Jennings Avenue, East Liverpool, had been indicted in February for photographing a child or minor in a state of nudity from May 1, 2023 through July 20, 2023. The other charge involved alleged possession of child pornography on July 20, 2023.
Two counts of illegal use of a minor or impaired person in nudity-oriented or performance and 24 counts of pandering obscenity involving a minor or impaired person were dismissed. He received credit for 132 days served in jail and was designated a Tier II sex offender requiring him to register his address with law enforcement when he’s released from prison.
County Assistant Prosecutor Steve Yacovone said this was his second case involving Frye sending sexually explicit material to someone. Then he got this case.
“This is one of the most disturbing cases I’ve had as a prosecutor,” he said.
In reviewing the details, he said Frye had videos he had taken of a teen girl in her room and the bathroom unbeknownst to her. He also had pictures of an adult woman that he shared with others, but Yacovone said there was no evidence that he shared the videos of the teen girl.
A search yielded the large amount of child porn images at his residence and during an interview, Frye admitted to all the acts.
“He kept referring to it as morbid curiosity,” Yacovone said.
Given the severity of the content, he said consecutive sentences were more than appropriate.
Two of Frye’s victims testified, with an adult woman speaking first about the pain and betrayal.
“I’m still struggling every day,” she said. “There is no fix for the damage he’s done. He deserves to spend the rest of his life in prison for all the pain he’s caused.”
“I have horrible anxiety,” the teen girl said.
She commented that there are sick and scary people out there and now she’s experienced that in the flesh. She said he isn’t a real man because a real man wouldn’t do what he did.
She asked the judge to take into account the damage he’s done and how his actions have affected her life.
Defense attorney James Wise asked the judge to follow the joint recommendation, saying his client took responsibility for his actions.
“I apologize for everything I did,” Frye said, saying he knows it’s not going to fix everything.
That’s when Washam interrupted him, pointing out that he did these actions over and over again.
“I know I shouldn’t have done what I did,” Frye said.
After the sentencing hearing, Yacovone said, “We’re happy the victims got some justice.”
