Man due 2nd competency examination
LISBON — Dillon T. Dellapenna, the East Liverpool man charged and in some cases convicted of violence and spitting on law enforcement and others, will have a second mental health evaluation done at the request of his defense attorney.
In Common Pleas Court last week, defense attorney Thomas Zena requested a second sanity evaluation for Dellapenna, 22, of Moore Street, who was found competent during an initial evaluation.
Zena has filed not guilty by reason of insanity pleas to some of the charges Dellapenna is currently facing from three separate 2018 cases.
Those cases combine for four counts of harassment with a bodily substance, two counts of assault and one count of assault of a corrections officer.
On April 27, 2018, Dellapenna is alleged to have harmed corrections officers Nicole DeRuyter and Matt Bumgarner, biting him as well as expelling bodily substances at corrections officer DeRuyter and a corrections nurse, Robert Hughes. Then on June 26, 2018, Dellapenna punched assistant warden William Delbridge, who was breaking up a fight between Dellapenna and another inmate, Larry O. Foster. Finally, he allegedly spit on another corrections officer, Wayne Wilson, in the county jail in September 2018.
A status conference for those cases is scheduled for Sept. 27.
These types of crimes are nothing new for Dellapenna, who also stipulated to violating the terms of his community control for past offenses from 2016 and 2017. Dellapenna has been on community control after he pleaded guilty to three counts of domestic violence, three counts of assault and three counts of harassment with a bodily substance on Aug. 28, 2017.
His community control now has been dishonorably terminated.
The domestic violence charge was for hitting Amy Risinger, his aunt, with a grill that he picked up and threw on Aug. 7, 2016. On Oct. 26, 2016, Dellapenna pushed and elbowed Deputy Sgt. Michael Helman and spit on Deputy Hartley Malone. Then on Dec. 16, 2016, Dellapenna spit on Joshua Quarry, a corrections officer. On Oct. 16, 2017, Dellapenna harmed Michael and Susan Goodballet and corrections officers Tyler Rhodes and Quarry again.
