LISBON -- A woman who did not appear to be truthful with either authorities or Columbiana Common Pleas Court Judge C. Ashley Pike on Friday was sentenced to 14 days in jail.
Daryl A. Burkey, 27, state Route 45, Wellsville, was in court to be sentenced on an obstructing official business charge. She initially had been charged with possession of drugs for having amphetamines during a traffic stop on March 26, 2016, but that charge was dismissed.
Burkey said she and her child had the same prescription, but Burkey's was for a high dose amount. The loose pill in the bottom of her purse was reportedly her child's. At one point during the hearing, Burkey said she did not know the pill needed to be in the original prescription bottle.
However, it was her actions after the discovery of the pill that got her into further trouble. Pike questioned Burkey about how "dishonest and uncooperative" it appeared she was with the highway patrol troopers.
Burkey claimed the Social Security number she gave them was actually an old phone number and only two digits off from her Social Security number. She claimed she did not purposefully misinform them.
Pike asked her to recite the phone number and Social Security number which she attempted to do, but with difficulty.
She also seemed confused about which vehicle she was driving at the time of the stop, asking her fiance in the courtroom for help remembering. At first she claimed the vehicle she was driving was her brother's, but when Pike and her fiance reminded her, she remembered it was her grandmother's.
Burkey's attorney, Christopher Weeda, said Burkey admitted to "losing it a tad bit" when she was dealing with the troopers after the pill was found in her bag. Weeda said Burkey apologizes for her actions.
Pike noted Burkey has a juvenile record, a misdemeanor record and the possession charge, which has been dismissed, would have been a felony.
"Now look Daryl, you're 27 years old," Pike said. "You need to grow up."
Pike sentenced her to 15 days in jail with credit for one day already served and he reminded her in the future she should not lie to the police.
"Make a plan for the rest of your life, that includes learning to tell the truth," Pike said.
