Wellsville village solicitor ready to file suit against owner of collapsed building
WELLSVILLE – The assistant columbiana county prosecutor who serves as the village solicitor Wellsville told village council Tuesday he is ready to file suit against the owner of the Main Street building that collapsed in March.
Chris Weeda told council members he is prepared to file the suit against Angelo DiSena, ADCD Lease LLC of Flint, Michigan, for damages and costs associated with the building collapsing. The former Five and Ten store partially collapsed March 6, destroying a neighboring business.
The building located at 449 Main St., has been a concern for some time for the village administration and for residents and Kristy Colter who owns the attached building, who at this point does not yet know if her part of the building, 447 Main St., will need to be demolished as well since the two buildings share an attic.
Council approved the hire of a structural engineer for up to $5,000 to make a determination on Colter’s building. Council also agreed to advertise and receive bids for the demolition of the building.
Village administration and council had debated having the village pay for the demolition of the building, which is more than 100 years old and condemned, but opted against that due to an over $100,000 estimate and the village not having that kind of money, along with concerns over being able to recover the cost of it from DeSena.
Mayor Bob Boley said he had received a bill from Kevin Kerr Construction in the amount of $37,500 for the equipment he brought from Youngstown ready to demolish the building. The equipment was there for nearly a week.
Main Street remains closed between Fourth and Fifth streets over safety concerns of the building collapsing further.
The Wellsville Village Council meets the first and Third Tuesday of each month at 6 p.m. in council chambers at Wellsville Village Hall, 1200 Main St. The next regular meeting is scheduled for April 21.
