Order to be issued against Rogers property for a septic nuisance

LISBON — A revised board order will be issued against the owner of a Rogers property for a septic nuisance, with a requirement to secure an EPA permit within 30 days related to replacement of the septic system.

“We’re going to keep this moving as best we can,” Columbiana County Health District Boart President Gary Dailey said.

A few residents had addressed the board previously about problems from sewer discharging into neighboring yards and ditches from the property on Pancake Clarkson Road, and two residents came to Wednesday’s meeting to request an update on where the case stands.

The property owned by Anylynn Allison was on the agenda for a board order to obtain the required permits and install a replacement household sewage treatment system to abate the existing sewage nuisance. A board order requires action within 30 days.

In this case, county Health Commissioner Wes Vins said the owner is in the process of getting started and Environmental Director Laura Fauss said there’s still a concern about funding, but the process is moving.

“If you don’t push them, they won’t do anything,” the woman in the audience said.

Dailey expressed hope that the board could keep this going, but admitted it’s not going to be abated within 30 days, which Vins said the board order would require. Vins said they could have another benchmark set, for them to get the Environmental Protection Agency permit,with Fauss noting the big step will be installation.

Board Vice President Dr. Kimberly Jackson made the motion to require getting the EPA permit within 30 days and the board agreed.

After the meeting, Fauss explained the process for replacing a septic system, saying it starts with completion of a site evaluation, then securing the EPA permit for discharge, the design plan, the septic permit and then installation.

In other board order business, the board issued an order against JHZ JES, LLC for an address on Carolina Avenue, East Rochester for a septic nuisance for septic going into a ditch, with no response from the owner regarding the complaint. The owner must install a replacement system. A board order was issued against Cythia King, Pritchard Avenue, Lisbon, for an accumulation of garbage, ordering that all garbage be removed.

A board order was also issued against Jared Adams of Salineville for a property on First Street, Hanoverton, which Hanoverton village officials had complained about during a previous board meeting, saying the structure was about to fall down. The board ordered that all debris be removed within 30 days so water can’t collect and harbor mosquitoes. The board can only address potential health issues, such as the collection of stagnant water, not structural issues.

If a board order isn’t corrected, the case can then go to county Municipal Court for criminal charges.

“It is a process. It takes time,” Jackson said.

The board granted a variance to Brandon Neville, state Route154, Lisbon, regarding the installation of a sewer pipe within 30 inches of the foundation, ruling that the old pipe was in good condition closest to the house and could be connected to the new pipe. The installer was advised to get as close as possible without disturbing the propane line and air conditioning/electrical.

In other matters, Fauss announced that oral rabies vaccination baits will be distributed between Aug. 17 and Sept. 16 by airplane, helicopter and car. The ORV baits are described as the size of a matchbox and coated with fishmeal flavoring, with the idea that raccoons, skunks, foxes and coyotes will eat the baits and become vaccinated against rabies.

“If you find the bait, don’t touch it,” Fauss said.

A notice with more details about the ORV baiting is posted on the health district’s social media site, along with information about ticks, West Nile Virus and other health concerns. Fauss said mosquitoes here are infected with West Nile, warning residents to be vigilant using mosquito repellent and dumping stagnant water. She also informed the board that the district received a notice of intent from Wilson’s Sandy Creek Farm LLC, U.S. Route 30, Kensington, that the company is applying to the U.S. EPA for a composting facility.

Health Services Administrator Amanda Amato talked about animal bites, saying the district just recently recorded its 100th incident.

“Wild animals are wild. Please don’t try to carry them or pet them,” she said.

She also reported the nursing department distributed 16 car seats and nine pack-n-plays at a Women, Infants and Children event. She said the district has plenty of vaccines available for back to school, for adults and has TB testing available. Anyone can call and make an appointment for any of those services.

The board awarded contracts for three bid groups for Water Pollution Control Loan Fund septic replacement or repair projects, with two projects per bid groups. For the bid group involving projects on Pancake Clarkson Road and Chippewa Trail, both in Middleton Township, the contract was awarded to Klarich Farms, LLC for $30,890. The other bidder was Advanced Excavating & Septic Services for $34,992.

Klarich Farms, LLC was also awarded the contract for the bid group in Center Township on U.S. Route 30 and Hunter Camp Road for $48,000. The other bidder was Advanced Excavating & Septic Services for $49,437.

Advanced Excavating & Septic Services won the contract for the final bid group for projects on Cricket Lane in St. Clair Township and East Liverpool Road in Madison Township for $36,239. The other bidder was Klarich Farms, LLC for $42,000.

The next board meeting will be 4:30 p.m. Sept. 17 at the health district office, state Route 45, Lisbon.
