State Farm lawsuit moved to federal court

LISBON -- A lawsuit filed in February by State Farm Fire & Casualty Company against Norfolk Southern over damages to two East Palestine homes allegedly due to the derailment has been moved to federal court.

The complaint is now part of the larger class action lawsuit filed last year in the U.S. Northern District Court in Youngstown.

The insurance company headquartered in Atlanta, Ga. originally filed the claim in Columbiana County Common Pleas Court in an effort to recoup payouts to replace or repair properties on East Main Street and Alice Street for two insured clients.

A payment was made on behalf of Justin Daubenmire, the owner of the property at 521 E. Main St., in the amount of $32,025 for the property itself and $39,374 for personal property for a total of $74,199, which includes the $2,799 deductible.

A payment of $13,051, subject to a $500 deductible, was made on behalf of Barbara Georgescu, the owner of property at 274 Alice Street.

The lawsuit was seeking damages equal to the amounts the insurance company had to pay on behalf of the two insured clients for issues allegedly caused by the train derailment and chemical fire last year.

The recent entry in Common Pleas Court said the case was remanded to the federal court this week.
