Green lawsuit has no resolution after discussions

EAST LIVERPOOL -- Legal counsel for former East Liverpool police officer Chris Green and that for the City of East Liverpool and individual named defendants have had several settlement discussions with no resolution in Green's civil lawsuit against the city, individuals in the city's administration and several officers in the city's police department.

Counsel for police officer Robert Ramsey, a named defendant, made an offer of judgment Oct. 20, which Green did not accept and replied with a counter demand, according to court documents from the United States District Court for the Northern District of Ohio Eastern Division.

Counsel for Green and the City of East Liverpool briefly discussed settlement Nov. 14 with no further discussions about a settlement taking place after that.

Court records indicate that further settlement discussions could be possible after the first of the year when the new administration for the city takes office.

Counsel for all parties held a phone conference Nov. 20 regarding a proposed motion for a protective order for an unnamed defendant.

Court records also note that counsel for the City of East Liverpool has contacted Shallow Creek Kennel and the Henderson County Sheriff's Department regarding K9 Nero, who has not been returned to Green. Green has not been presented an opportunity to retrieve or purchase the K9.

Green's counsel has contacted Shallow Creek Kennels on Oct. 5 to request disclosure of K9 Nero's whereabouts. The kennel produced a receipt showing K9 Nero was sold to the Henderson County Sheriff's Office in Hendersonville, North Carolina on July 13, 2021.

Discovery is an issue in the litigation currently. Court records filed Dec. 14 show that counsel for the defendants, City of East Liverpool, Greg Bricker, David Dawson, Fred Flati, Darin Morgan and Chad Tatgenhorst are requesting a 45-day status report and that they have not yet been served with nor have they served any type of discovery.

The defendants are anticipating the need to reset the fact discovery deadline which is currently set for March 1.

No action is scheduled in the matter until Jan 10 when a phone conference is scheduled at 1:30 p.m. for all counsel involved in the matter.
