Appeal puts Bosel’s sentence on hold
YOUNGSTOWN — The judge who sentenced former Columbiana County recorder Theresa Bosel on Dec. 29 to 30 days of house arrest and other sanctions has stayed the sentence pending the outcome of an appeal Bosel has filed.
A stay prevents further action until a future event occurs.
Bosel’s attorney, Edward Hartwig, appealed the sentence and the court’s finding of Bosel guilty of vehicular manslaughter. The matter was filed with the Seventh District Court of Appeals on the same day Mahoning County Area Court at Canfield Judge Molly Johnson imposed the sentence.
Hartwig stated in a filing that the sentence was contrary to law and that Bosel’s guilty plea to vehicular manslaughter was not made voluntarily, intelligently and/or knowingly.
Hartwig stated in a filing that Bosel’s sentence should be stayed “as the entire sentence would be served before (Bosel’s) appeal would be concluded.”
More specific information on why Bosel is appealing will be provided in a later filing, he said.
Bosel, 49, pleaded no contest in November to vehicular manslaughter, a misdemeanor. Johnson found her guilty and sentenced her to 90 days in jail with 60 days suspended and the other 30 days to be served on house arrest, one year of probation and 120 hours of community service. The judge suspended Bosel’s driver’s license for two years and ordered Bosel to submit to a type of physical examination spelled out under Ohio law to determine her fitness to drive.
Bosel’s conviction resulted from an 11:10 a.m. Aug. 19, 2019, crash on Western Reserve Road in Beaver Township, according to the Ohio State Highway Patrol. Bosel crossed the center line, striking two vehicles, killing Cecil Chamberlain, 69, formerly of Salem, who was driving one of the vehicles.
His wife, Roberta Chamberlain, who was also in the car, filed a civil suit in Mahoning County Common Pleas Court in 2019 naming Bosel as a defendant. It sought damages in excess of $25,000, including more than $85,000 in medical expenses related to the care of Roberta Chamberlain for her injuries.
The parties settled the lawsuit, allowing it to be dismissed Dec. 10, according to a filing.
