Woman’s silence equals 3 years

LISBON — Lisa Mutter, the former Salem area woman who was having unprotected sex with men without informing them about her HIV positive status, was sentenced to three years in prison on Thursday morning.

Mutter, 42, who currently lists her address as Pulaski, Pa., appeared before Columbiana County Common Pleas Court Judge Scott Washam for sentencing. She had pleaded guilty to felonious assault in early January.

The charge was a second-degree felony, which could have meant up to eight years in prison. But as part of the felony plea agreement, the county prosecutor’s office was recommending the three-year prison term.

Court documents state Mutter knew in May through July 2014 that she had tested positive for the virus which causes Acquired Immunodeficiency Syndrome (AIDS). Yet during that time period she had sex with nine men in Columbiana County without disclosing her HIV positive status to any of them.

Columbiana County is not the only county where she faces charges for her sexual behavior. Mutter is also scheduled to appear in Trumbull County after she reportedly was having sex in the Hubbard area, again without telling her sexual partner about her HIV status. She is scheduled to appear for a pretrial on March 28 in Trumbull County Common Pleas Court on another felonious assault charge, also a second-degree felony.
