LISBON — A defendant’s motion to dismiss the indictment in his drug possession case has been overruled.
Joshua Daniel Davidson, 32, last known address Northview Lane, Lisbon, was served in October this year with a secret indictment issued in September 2024 for possession of cocaine, a fifth-degree felony, for allegedly possessing cocaine on Jan. 15, 2023.
The motion claimed the state of Ohio failed to act diligently to get the indictment served, claiming his right to a speedy trial was violated.
Columbiana County Common Pleas Court Judge Scott Washam wrote in his judgment entry denying the motion that the record demonstrates the defendant was partially responsible for the lapse in time before the filing of the indictment and its service on him. The sheriff’s office tried to serve the indictment and was told he no longer lived at the New Waterford address on the paperwork. He had used at least three different addresses before and after the filing of the indictment.
Washam also said Davidson had not shown that the passage of time resulted in any prejudice in his case and there was no evidence that his ability to mount a defense was diminished. There was also no evidence that any of the evidence was lost or destroyed due to the passage of time.
His case remains pending.
