Court News
LISBON — A case against a Steubenville man related to a shooting incident was dismissed recently after the Columbiana County Grand Jury decided against issuing an indictment.
Kenneth Shepard, 39, had been charged in county Municipal Court with second-degree felony improperly discharging a firearm at or into a habitation and third-degree felony having weapons while under disability for an incident March 27 for allegedly discharging a gun into the floor of an upstairs apartment, with the bullet entering the downstairs’ resident’s living room 15 feet from where she was sitting on the couch watching television. A witness alleged that Shepard was decocking his revolver when it discharged into the floor. The witness ran downstairs to check on the neighbor and Shepard allegedly fled in a vehicle, a court affidavit said. Shepard was prohibited from having a firearm due to a previous conviction.
When the case came before the county grand jury, the grand jury issued a no bill of indictment, causing the case to be dismissed.
Municipal
LISBON — In Columbiana County Municipal Court, cases against Nick Rhodes, 50, old state Route 344, Leetonia, were bound over to the county grand jury for third-degree felony tampering with evidence, fourth-degree felony aggravated menacing and misdemeanors of domestic violence, obstructing official business, resisting arrest and endangering children.
Rhodes allegedly threatened a woman with a knife during a domestic incident on July 21 in Leetonia where he broke the shifter of her vehicle, threatened to break the window when she locked him out of the vehicle and threw the knife at the rear driver’s side tire, causing the tire to deflate. A child was in the vehicle at the time. He also allegedly tampered with the knife in the garage after the incident and when told he was being detained, he allegedly ran from a sheriff’s deputy, refused commands to turn around and place his hands behind his back and was tased, again running and then fighting with deputies handcuffing him.
A case against Daniel J. Hosek, 51, Munroe Falls, was bound over to the county grand jury for third-degree felony compelling prostitution, fourth-degree felony attempted unlawful sexual conduct with a minor and fifth-degree felonies of importuning and possessing criminal tools for allegedly requesting sexual conduct for an agreed upon price of $160 from a female he believed to be 15 years old, but was an officer posing as a minor via a telecommunications device, then drove to Salem on Aug. 1 for the meeting, with the phone used to make the arrangements in his possession.
A preliminary hearing was set Aug. 22 for Ralph K. Lee, 47, Broadway Avenue, Wellsville, charged with first-degree felony failure to verify residence address and fifth-degree felony breaking and entering. Lee allegedly failed to verify where he lived on May 22 as required since he was a registered sex offender. On March 3 in East Liverpool, he was allegedly caught in the act of stealing three stained glass windows from a property on St. Clair Avenue.
A preliminary/pretrial hearing was set Aug. 22 for Arthur Gingher, 54, Hofmeister Road, Petersburg, charged with fifth-degree felonies of possessing criminal tools and tampering with coin machine and misdemeanor criminal damaging for allegedly breaking into gaming machines at a laundromat in East Palestine on Aug. 10. When police responded, he was allegedly found with a flashlight and a large amount of change in his pockets that he claimed was for doing laundry. The business owner checked the video footage which a police affidavit said showed Gingher using some sort of pry bar to break the locks on three separate coin-activated gaming machines, then taking small buckets from each of the machines and emptying the quarters from the buckets into his hands, then into his pockets. The affidavit said Gingher allegedly stole $30 to $40 in quarters.

Stelmach, 61, Hamburg, N.Y., charged with engaging in prostitution and possessing criminal tools for allegedly responding to an undercover ad on a known prostitution website and arranging for sexual activity with a female in exchange for $140, then traveling to East Palestine on Aug. 9 for the meeting.
A pretrial was set Oct. 21 for Scott Michael Flenke, 61, Harrisburg, Pa., charged with engaging in prostitution and possession criminal tools for allegedly responding to an undercover ad on a known prostitution website and arranging for sexual activity with a female in exchange for $140, then traveling to East Palestine on July 28 for the meeting.
A pretrial was set Oct. 3 for Gary Michael Bartko, 40, Pittsburgh, Pa., charged with engaging in prostitution and possessing criminal tools for allegedly responding to an undercover ad on a known prostitution website and arranging for sexual activity with a female in exchange for $180, then traveling to East Palestine on June 16 for the meeting.
A pretrial was set Oct. 28 for Joe McVay, 36, Wellsville Avenue, Lisbon, charged with aggravated menacing for allegedly threatening a man on state Route 45, Center Township, with the victim alleging that McVay brandished a handgun during the incident on Aug. 10.
James Reich, 52, East Martin Street, East Palestine, was fined $250 and sentenced to 180 days in jail, with 179 suspended and credit for one day served, for assault. A charge of criminal trespass was dismissed. Reich was ordered to complete 40 hours community service. He was accused of causing physical harm to another man during an incident on June 8 in East Palestine.
Steven Conkle, 72, Dakota Street, East Liverpool, was fined $250 and given a suspended 60-day jail term for theft. He was ordered to stay away from the Calcutta Walmart. Conkle failed to scan and pay for 14 items totaling $167.29 at the Calcutta Walmart on Feb. 3.
Tammy Merriman, 53, Martha Street, East Liverpool, was fined $150 and sentenced to 90 days in jail, with 88 days suspended and credit for two days served, for obstructing official business. She was ordered to complete 20 hours community service and to stay away from a man she denied was in a residence in Negley. Merriman denied anyone was on the property or in the home on state Route 154 when deputies were looking for a man with an active arrest warrant on May 14. Deputies located the man hiding in a closet in the back bedroom.
A pretrial was set Nov. 14 for Mohamed Nahshal, 23, East State Street, Salem, charged with trafficking in cigarettes without a license, failure to post tobacco license or comply with the law and selling at less than cost for violations related to cigarette sales at One Stop Tobacco and Vape where there allegedly was no current license and Marlboro red cigarettes were being sold at less than state minimum pricing when agents from the Ohio Department of Taxation Criminal Investigations Unit visiting the Salem store on July 25.
Joshua Daniel Davidson, 31, state Route 7, New Waterford, was fined $400 and sentenced to 30 days in jail, with 27 days suspended, leaving three days to serve in jail, for driving under suspension, obstructing official business and disorderly conduct amended from assault. A charge of physical control was dismissed. Davidson refused to speak about a vehicle crash on May 29 on Crestview Road east of Fairfield School Road near the railroad tracks while seated in the passenger seat of the vehicle. He had been accused of using force to push another man out of a residence on Crestview Road while yelling at him to leave on May 26.
Kayla Clingerman, 37, Walnut Street, Salem, was sentenced to 21 days in jail, with credit for eight days already served, leaving a balance of 13 days still to serve for violating her probation for charges of illegal use or possession of drug paraphernalia and disorderly conduct from two separate cases dating back to earlier this year when she possessed a small bag with an unknown residue which she said contained methamphetamine on April 1 in Salem and a disorderly situation on Feb. 10 in Salem. A status conference hearing was set Aug. 19 and a court trial was set Aug. 26 for another charge of illegal use or possession of drug paraphernalia for an incident when she allegedly possessed a cut red straw with an unknown white residue on May 23 when she was found in someone else’s back yard with a knife.
A pretrial was set Nov. 12 for Cornelius Chunn, 42, Bedford, charged with drug paraphernalia for allegedly possessing a digital scale with a white powder residue in his vehicle during a traffic stop on Aug. 6 in Fairfield Township.
Marvin Wengerd, 23, Carmel Achor Road, Negley, was fined $150 for disorderly conduct for playing loud music in Negley on Aug. 4 after previously being warned to cease the conduct.
A charge of criminal mischief was dismissed against Lee Guterba, 63, Kelly Park Road, Leetonia. Guterba had been accused of allegedly damaging a wooden bench at a property on Kelly Park Road, Leetonia on Oct. 27, 2023.
Randall Wooster, 50, Chris Avenue, Washingtonville, was fined $1,150 ad sentenced to 180 days in jail, with 155 days suspended and credit for three days served, leaving a balance of 22 days still to serve in jail for operating a vehicle impaired, expired registration and resisting arrest. A charge of obstructing official business was dismissed. His driver’s license was suspended for one year and he was ordered to complete 20 hours community service. Wooster resisted when placed under arrest and was tased after receiving multiple warnings to comply with police officer orders on Feb. 23.
Dylan Walsh, 23, Lacroft Avenue, East Liverpool, was fined $650 and sentenced to 90 days in jail, with 80 days suspended, leaving 10 days to serve in jail for driving under suspension, expired registration, expired license, illegal operation of dealer’s motor vehicle and unsafe vehicle. He was ordered to complete 40 hours community service.
A pretrial was set Nov. 14 for Jason Naylor, 38, McCoy Avenue, Calcutta, charged with OVI second offense, marked lanes and a turn signal violation.
A pretrial was set Oct. 21 for Gregory Lindner, 63, Lyons Avenue, East Palestine, charged with OVI first offense, OVI breath first offense and lighted lights required.
Serena Edgerton, 21, Canfield, was fined $900 and sentenced to 30 days in jail, with 27 days suspended and credit for three days served in a driver intervention program, for OVI and marked lanes. A charge of open container was dismissed. Her driver’s license was suspended for one year, with driving privileges granted. She was ordered to complete 20 hours community service.
A pretrial was set Sept. 19 for Jamie Anne Rickerd, 37, Seventh Avenue, East Liverpool, charged with failure to stop after an accident and assured clear distance.
Felix Velasquiez, 21, South Lundy Avenue, Salem, was fined $150 for driving while texting, with charges of driving under suspension and improper registration dismissed.
Donald Nesselrode, 57, Oak Street, East Liverpool, was fined $150 for driving under suspension.
Noah Davis Sr., 61, Opal Drive, Wellsville, was fined $200 for driving under suspension.
Jacob Henry, 24, Youngstown, was fined $150 for unsafe vehicle amended from speeding.
Corey Mills, 33, Akron, was fined $300 for driving under suspension and speeding.
Phillip Kelley, 36, North Broadway Avenue, Salem, was fined $150 for driving under suspension.
