Grand Jury
LISBON — A Salem man accused of multiple counts related to child porn was one of 19 people openly indicted by the Columbiana County Grand Jury last week, along with two additional residents charged for allegedly stealing from Norfolk Southern.
The grand jury met for two days examining 47 witnesses covering 46 cases and issued 19 open indictments and 27 secret indictments. Secret indictments aren’t made public until the defendant is served with the paperwork.
Barry Stephens, 63, Depot Road, was charged with one second-degree felony count of pandering obscenity involving a minor or impaired person and 50 counts of fourth-degree felony pandering obscenity involving a minor or impaired person.
According to a police affidavit filed in Columbiana County Municipal Court, a search warrant was executed Feb. 29 at Stephens’ residence and a preview was conducted on the computer he used, allegedly revealing in excess of 2,000 images and videos depicting children, some appearing to be toddlers, engaged in sexual acts and in a state of nudity. Also, he had allegedly reproduced or published an image of a juvenile to Microsoft Bing which would be classified as obscene material on Nov. 28, 2022.
Defendants charged with counts related to receiving funds from the Norfolk Southern Assistance Center allegedly by illegal means included Melissa Blake, 41, Quay Road, Negley, charged with fourth-degree felonies of falsification in a theft offense and grand theft and fifth-degree felony forgery for allegedly collecting $19,690 from Norfolk Southern for a forged rent deposit and fake rental agreement related to being displaced after the 2023 train crash. She was also accused of making false statements. The time period was listed on the indictment as Feb. 5, 2023 to Aug. 31, 2023.
Scott McAleer, 56, Alice Street, East Palestine, was indicted for fourth-degree felonies of grand theft and falsification in a theft offense related to alleged fraudulent hotel bills sent to Norfolk Southern for reimbursement between April 1, 2023 and Oct. 10, 2023. According to a police affidavit, McAleer allegedly received $15,419 for the fake hotel stays from the assistance center set up after the February train crash.
Other open indictments issued included:
— Samuel Lalley, 32, West Salem Street, Columbiana, third-degree felony tampering with evidence and five counts of fourth-degree felony pandering obscenity involving a minor or impaired person for allegedly resetting his cell phone and not coming out of a room with the door shut when officers called out to him during the execution of a search warrant for electronic items Dec. 6 in Columbiana. He allegedly admitted the phone contained criminal files on it and that he threw it under his bed.
— William C. Wolfe, 49, El Reno, Okla., third-degree felony compelling prostitution, fourth-degree felony attempting unlawful sexual conduct with a minor, fifth-degree felony possessing criminal tools and misdemeanor engaging in prostitution for allegedly responding to an undercover ad on a known prostitution website of an adult female and 15-year-old juvenile and arranging for sexual conduct with both females in exchange for money, then driving to East Palestine on Feb. 3 for the meeting.
— William Santimarino, 35, Hammondsville, charged with third-degree felony having weapons under disability and misdemeanor possessing a defaced firearm. During a traffic stop on Jan. 23 in Wellsville, Santimarino allegedly possessed a loaded gun with a grinded serial number when he was prohibited from having a firearm due to a prior felony conviction.
— Steven McGrew, 38, Pine Lake Road, Beloit, third-degree felony failure to comply with the order or signal of a police officer for allegedly attempting to flee from police on Feb. 24 in Salem, leading them on a chase at speeds sometimes in excess of 90 mph before they suspended the chase.
— Jasper Mountz, 40, Bethesda Road, Kensington, fourth-degree felony trespass in a habitation when a person is present or likely to be present and misdemeanor illegal use or possession of drug paraphernalia for allegedly entering an attached garage in Salem without permission and possessing drug paraphernalia on March 4.
— Devontay Bickley, 22, Chester, W.Va., charged with third-degree felony escape, fifth-degree felony harassment with a bodily substance and misdemeanors of menacing, resisting arrest, and two counts operating a vehicle under the influence of alcohol or drugs. Bickley allegedly resisted arrest and spit saliva into the face of an East Liverpool police officer while being placed into custody for allegedly being under the influence on Jan. 29. He also allegedly attempted to escape by climbing through the window into the front seat of the cruiser and continuously threatened the officers.
— Charles S.L. Bell II, 20, Blakely Street, East Liverpool, misdemeanors of assault and criminal damaging. An affidavit alleged he discharged a pellet gun at a vehicle on Ohio Avenue in East Liverpool on March 4, damaging a window and allegedly harming a woman who was in the vehicle and said she was hit in the face with glass.
— Dustin Scott Andric, 41, St. Jacob-Logtown Road, Lisbon, third-degree felony failure to comply with the order or signal of a police officer and misdemeanors of driving under suspension and unauthorized plate for allegedly fleeing from an Ohio State Highway Patrol trooper attempting a traffic stop on Dec. 30 in Salem Township, then crashing the vehicle and fleeing on foot.
— Larry Foster, 68, Struthers, second-degree felony aggravated possession of drugs, third-degree felony having weapons under disability, fifth-degree felony possession of cocaine and misdemeanor drug paraphernalia for allegedly having a gun in his vehicle and a burnt pipe used to inhale a narcotic during a traffic stop on Dec. 29 in East Liverpool. He also possessed cocaine and methamphetamine.
— Robert R. Smith, 47, Madison Township, fifth-degree felony receiving stolen property for possessing an equipment trailer which was the property of Kevin Chronister on Aug. 19, 2023.
— Nathen Wiseman, 33, who was listed as homeless, third-degree felony failure to verify address for allegedly failing to verify his address on Dec. 20, 2023 as required as a registered sex offender.
— Seth Mora, 30, Anderson Boulevard, East Liverpool, second-degree felony felonious assault and misdemeanor domestic violence for allegedly choking a woman during a domestic on Jan. 27 in East Liverpool.
— Cody Lawson, 27, Berlin Center, fourth-degree felony domestic violence for allegedly striking a woman in the ribs and mouth and ripping her hair during a domestic on March 9 in Perry Township.
— Justina Desarro, 34, Cannons Mill Road, East Liverpool, fourth-degree felony trespass in a habitation when a person is present or likely to be present for allegedly climbing through a window into a residence where she wasn’t permitted on Feb. 19.
— James Perry, 43, East Ruby Drive, East Liverpool, charged with fourth-degree felony strangulation and misdemeanors of domestic violence and intimidation of an attorney, victim or witness in a criminal case for allegedly grabbing a juvenile by the throat and pushing her against a door during a domestic on March 9 in St. Clair Township.
— Nicolas Ortiz, 24, Dover, charged with third-degree felony compelling prostitution and fifth-degree felonies of attempted unlawful sexual conduct with a minor, importuning and possessing criminal tools for allegedly requesting sexual conduct from an undercover agent posing online as a 15-year-old female in exchange for $100 and then driving to Salem on March 8 for the meeting.
