LISBON — A man ordered to prison for 10 months for violating his probation for two protection order violations filed an appeal this week to challenge the sentence.
John Yerkey, 49, North Lima, filed the documents with the Seventh District Court of Appeals in Youngstown over the recent order issued for two 2018 cases in Columbiana County Common Pleas Court.
Yerkey had been charged n 2018 with two counts of violation of a protection order, a fifth-degree felony.
He had been placed on probation, but that probation was dishonorably terminated and he received credit for 44 days already served in jail.
In Common Pleas Court:
— A motion to suppress evidence was denied for Khalide Moore, 25, Gardendale Street, who is facing first-degree felonies of possession of cocaine, trafficking in cocaine, possession of fentanyl-related compound, trafficking in fentanyl-related compound, a fourth-degree felony receiving stolen property and specifications for forfeiture of money in a drug case and major drug offender specifications. The motion claimed the search warrant for his residence was improperly issued. A judge found there was probable cause for the search warrant based on observances of several drug buys by an agent. Moore was charged after the Columbiana County Drug Task Force executed the search warrant on July 18 and found a large bag of suspected narcotic tablets and a large bag of suspected narcotics in a cabinet in the kitchen. Lab tests confirmed the 994 tablets contained fentanyl and the other substance was 583.04 grams of cocaine. The currency totaled $25. A jury trial remains set for Jan. 10, with a status hearing Jan. 5.
— Aaron Yonker, 27, Ravenna, pleaded guilty to fourth-degree felony attempted unlawful sexual conduct with a minor, with sentencing set for March 14. Yonker was accused of sexual conduct with a 15-year-old girl after making arrangements with an undercover agent posing as an adult prostitute offering her friend in exchange for $60 and an iced coffee. He drove to Salem for the meeting on Feb. 24.
— Laura Blake, 57, Youngstown, was placed on probation for three years for tampering with evidence, a third-degree felony, and possession of cocaine, a fifth-degree felony. She received credit for 24 days served in jail. Blake possessed cocaine and attempted to hide it on June 15, 2021.
— Morgan Kaser, 22, West Main Street, Salineville, was sentenced to 18 months in prison and given a mandatory fine of $5,000 for violating the conditions of the drug court program for possession of cocaine, a third-degree felony, and possession of fentanyl-related compound, a fourth-degree felony, and two counts of fifth-degree felony aggravated possession of drugs, with specifications for forfeiture of money in a drug case. The charges stemmed from a 2022 drug raid in Salineville and involved cocaine in an amount equal or greater than 10 grams, but less than 20 grams, fentanyl-related compound in an amount equal or greater than 1 gram but less than 5 grams, oxycodone and 6-MAM (6-monoacetylmorphine). The forfeiture specification dealt with $111. Kaser was dishonorably terminated from the drug court program. The sentence also involved a violation for a separate case for possession of fentanyl-related compound and aggravated possession of drugs, both fifth-degree felonies, for possessing oxycodone and fentanyl on April 2, 2021.
— Richard Spinelli, 60, Streetsboro, was sentenced to prison for nine months for attempted compelling prostitution, a fourth-degree felony lesser offense from compelling prostitution, and fourth-degree felony attempted unlawful sexual assault with a minor. He received credit for four days already served in jail. Spinelli made arrangements to meet an officer posing as an adult female and 15-year-old female for sexual activity in exchange for $240 on Aug. 26, 2022 in East Palestine.
— An entry for a plea hearing was corrected for Shaun Uscianowski, 45, West 16th St., Salem, who pleaded guilty to one count of aggravated possession of drugs, a third-degree felony, three counts of aggravated possession of drugs, a fifth-degree felony, and two counts of fifth-degree felony possession of drugs, with sentencing set for Feb. 22. Uscianowski was accused of possessing $22, an amount of methamphetamine equal or greater than bulk amount but less than five times the bulk amount, buprenorphine, THC, MDMA, methamphetamine and clonazepam. The charges stemmed from a drug raid by the Columbiana County Drug Task Force and Salem police at his home on May 17, 2022.
— Brittany Flowers, 34, Akron, was placed on a treatment plan for three years after pleading guilty to aggravated possession of drugs, a fifth-degree felony, for possessing methamphetamine on Dec. 28, 2022. She received credit for two days served in jail.
