Columbiana man wins appeal regarding new construction

COLUMBIANA — After a 10-minute special meeting Monday, a Columbiana man won his appeal regarding new construction on a lot in the 500 block of Parkview Drive.

The city’s Board of Zoning Appeals agreed to grant John Ciardi’s request for a 9-foot-wide side yard variance, after his zoning permit for construction of a three-bedroom ranch home at 555 Parkview Drive was denied by a city zoning inspector.

Several neighboring property owners, including the city parks and cemetery, were notified of Monday’s public hearing and didn’t appear to express objections to Ciardi’s request.

In addition to Ciardi, board members (except an absent Terry Kelley) also heard from deputy zoning inspector Bryce Miner, who said the permit was rejected due to violating 1270.04 of the city’s zoning code as the proposed driveway would restrict the sideyard.

In response to an inquiry of the present board members, which was only four of the five, municipal attorney Mark Hutson directed that in order to override the zoning inspector, a vote of three Board of Zoning Appeals’ members were needed.

Ciardi has proposed new home construction on the property at 555 Parkview Drive. The deputy city administrator/deputy zoning inspector denied the issuance of a zoning permit due to the driveway on the eastern side of the yard not meeting the required 9-foot setback for a side yard in an R-1 zoning district. Ciardi is requesting a 9-foot side yard width variance.
