EL man appeals 6-9 year sentence for abuse of boy

LISBON — An East Liverpool man ordered to prison for six to nine years for abusing his girlfriend’s toddler son filed an appeal Friday to challenge the judgment and sentence.

Thomas C. Browning III, 38, had been found guilty by a Columbiana County Common Pleas Court jury of felonious assault and endangering children after a trial in late June, then sentenced to prison July 2 by Judge Scott Washam.

The appeal was filed with the 7th District Court of Appeals.

The abuse of the child occurred between Christmas 2019 and March 11, 2020 in Browning’s home.

During sentencing, assistant county Prosecutor Tammie Riley Jones requested a minimum seven-year prison term for Browning, citing the seriousness of the injuries to the child and the fact that Browning had a past criminal record that included charges of assault and domestic violence. She also said he never appeared to show any remorse during the jury trial during his testimony.

A prior story described some of the injuries to the boy, who turned 2 years old during the time period of the abuse, including the violent pulling of his hair and pinching of his ears. A black eye, bruises and injuries described at the trial included the pooling of blood under the scalp where the skin was pulled away from the bone.

Browning had maintained his innocence during the trial and at sentencing, with support from family members who attended the proceedings.
