Former bar owner sues to force its foreclosure

LISBON – A woman who loaned money to the current owners of the Side Door in Salem has filed a civil lawsuit in Columbiana County Common Pleas Court, demanding the property be part of four parcels foreclosed upon due to lack of payment.

Tonia Gerber of Salem has filed the lawsuit against Beckbren LLC, Columbiana, requesting the foreclosure sought for an unpaid $250,000 loan she allegedly made to the owners of the Side Door Bar, Brent and Rebecca Rupert in March 2009.

According to court documents, the loan called for a 5 percent interest rate, with $2,500 monthly payments for 23 months, followed by either a balloon payment for the final amount or another 12 months of even payments with a smaller balloon payment at the end of the 36-month period.

Four parcels comprise the properties with the street addresses of 508 and 530 S. Broadway. The Side Door Bar is located at 530 S. Broadway.

Court documents state the mortgage has not been paid in full and has been broken, but do not state how many of the payments were not made. The lawsuit does note that property taxes on three of the four parcels remain unpaid, as well, for the last half of 2012.

Gerber is seeking the properties to be foreclosed and sold at sheriff’s sale.
